The Tri-State Crematory Case
The nation was horrified when facts came to light that an unlicensed crematory operator had discarded over 1,000 bodies on his property in Noble, Georgia. David Randolph Smith filed the first case, a class action suit, and was Class Counsel in the federal court trial in Rome, Georgia. The NHC Nursing Home Fire
On September 25, 2003 a six-alarm fire occurred at the NHC nursing home in Nashville, Tennessee. Sixteen persons died in the fire. Thirty-two lawsuits were filed. The firm represented the Estate of Jesse Joe Tribble in a wrongful death action Putnam County, West Virginia against Andrew J. Whittaker, Jr. and the Estate of Brandi L. Bragg, deceased. On December 26, 2002, Jack Whittaker won the largest Powerball Lottery prize in history-- $314.9 Million Dollars, receiving a one-time lump sum payment of $113,386,407.77 after taxes. The suit contended Mr. Whittaker negligently failed to control his minor granddaughter's use of drugs at his residence which led to the death of Jesse Tribble. After five days of trial in March 2007 the case settled for a confidential amount (link).
CCA Prison Death Homicide Case
On July 5, 2004 Estelle Richardson was found dead in her solitary confinement cell at Corrections Corporation of America's Metro-Davidson County Detention Facility at 5115 Harding Place in Nashville, Tennessee. The death of Estelle Richardson was been classified by both the Medical Examiner and the police department as homicide.The firm represented the two surviving minor children (aged 14 and 6) through their legal conservator in a suit filed in U.S. District Court in the Middle District of Tennessee.
